Fair Usage Policy (FUP) for Email and Domain Hosting Services
This Fair Usage Policy ("Policy") is designed to ensure the fair and efficient use of email and domain hosting resources by all customers of Rediff.com India Limited ("we", "our", or "us"). By using our services, you ("Customer", "you", or "your") agree to comply with this Policy.
Purpose
This Policy aims to prevent misuse and overutilization of service resources, particularly email storage and domain hosting, to ensure high availability, performance, and reliability for all customers.
Allocated Resources
Each Client is entitled to specific resource allocations under its selected Service Plan, as agreed at the time of purchase. Such resources include, but are not limited to:
- Email Storage Quota (for example, 5 GB per user or per domain)
- Domain Hosting Storage Quota (for example, 2 GB per domain)
- Email Sending Limits (for example, 500 emails per day)
Important: Any use by the Client in excess of these allocations will be deemed a breach of fair usage. Rediff.com reserves the right to restrict, suspend, or terminate services for any Client whose usage exceeds the agreed limits, unless otherwise expressly authorised in writing by Rediff.com.
Storage Utilisation and Enforcement
- Quota Enforcement. Each Client is allotted a defined storage quota pursuant to their Service Plan. Utilisation of storage resources by the Client in excess of such Quota constitutes a violation of this Policy.
- Notification & Remedial Measures. Upon detection of excess usage, Rediff.com shall issue a written warning as per the clause 5 of the Schedule to the Client, affording the Client seven (7) days from the date thereof to remedy the breach, either by data deletion or by executing an upgrade to a Service Plan commensurate with actual usage.
- Restriction of Services. In the absence of timely remediation, Rediff.com may, after the expiry of the grace period, temporarily restrict, suspend, or deny the Client's ability to store further data, upload content, or utilise other features, without prejudice to continued access for the exclusive purpose of compliance.
- Termination and Deletion. Upon failure to cure within an additional period of fourteen (14) days, Rediff.com may suspend the Client's account in its entirety and, after an additional notice period of seven (7) days, permanently delete all Client data, without further notice, in accordance with its Data Retention Policy.
- Mandatory Upgrade. Clients whose usage requirements consistently or repeatedly exceed the Quota shall be required to migrate to, and purchase, an upgraded Service Plan, as a condition of continued service.
- No Liability for Enforcement. Rediff.com shall have no liability to the Client or any other person for any loss, destruction, or unavailability of data, or interruption of service, resulting from actions taken in accordance with this Policy, provided appropriate notices were given.
- Binding and Amendments. This Policy is incorporated by reference into, and shall form part of, the principal Service Agreement. Rediff.com reserves the right to amend this Policy from time to time upon written or electronic notice to the Client.
Fair Usage Guidelines
- You must monitor your usage and remain within the allocated storage and sending limits.
- The services must not be used for:
- Bulk email campaigns or spam
- Hosting large media files not related to your domain/email usage
- Backup or archival purposes not directly related to business communication
- Email accounts should be actively maintained. Dormant accounts storing large volumes of old data may be subject to clean-up after due notice. For explanation a "Dormant Account" means an account where no activity has happened in previous 90 days.
- It is the client's responsibility to maintain the backup of all data prior to service termination. Following termination, data may remain recoverable for upto 30 days. After this period, Rediff reserves the right to permanently delete all associated data without further notice.
- The Client acknowledges that the Service includes automatic archival and purging of email data in accordance with the Provider's data retention policy. The Client is responsible for reviewing and retrieving any data prior to scheduled purging.
Monitoring and Notification
We reserve the right to monitor your usage to ensure compliance with this Policy. If you exceed your quota:
- You will receive a warning notification to reduce usage or upgrade your plan.
- If usage continues beyond the grace period, services may be restricted, suspended, or terminated until compliant or upgraded.
Enforcement and Remedies for Overuse
If your usage exceeds the limits defined under your subscribed service plan, the following actions will be taken in a stepwise and transparent manner to bring your account into compliance:
Notification and Grace Period
- Upon detection of overuse, we will notify you via email and/or your account dashboard, providing details of the usage breach.
- You will be granted a grace period of 7 calendar days to take corrective action. During this period, no service disruption will occur.
- During the grace period, you may:
- Upgrade your plan to a higher-tier offering increased storage
- Delete old or unnecessary data (emails, attachments, hosted files) to bring your usage under the agreed limits
- Archive and download data to local storage
Temporary Restriction (Blocking)
- If corrective action is not taken within the grace period, we reserve the right to temporarily restrict certain services, including but not limited to:
- Blocking the ability to send or receive new emails
- Disabling webmail or hosting file uploads
- Access to the account will still be available so the user can manage their data and reduce usage.
- Services will be reinstated once usage is within permitted limits or a plan upgrade has been completed.
Account Suspension and Termination
- If usage remains above limits for more than 14 calendar days after the grace period or if you repeatedly breach fair usage limits:
- The account may be suspended, meaning all services will be inaccessible
- A formal notice will be issued providing 7 days to resolve the breach
- If no resolution is made within the final window, the account may be permanently terminated and all associated data deleted in accordance with our Data Retention Policy
Overage Charges
- In cases where continued overuse significantly impacts service quality or resources, and no corrective action is taken, we reserve the right to levy overage charges as per applicable rates.
- Overage charges will be billed from the succeeding month and shall not be waived off.
Dispute Resolution
If you believe the usage readings are incorrect or wish to dispute any charge or enforcement action, you must contact our support team within 7 days of notification. We will review and respond within a reasonable time frame.
Modifications
We reserve the right to amend this Policy at any time. Continued use of our services after changes constitute acceptance of the updated policy.
